These Terms of Service ("Terms") govern the access to and use of the website www.local-jyf.com, its mobile version, web applications, software, communication systems, databases, dashboards, payment interfaces and all related services (collectively referred to as the "Platform"), owned and operated by ValVicino Technologies Private Limited, a company incorporated under the provisions of the Companies Act, 2013, having its registered office at No. 206, 3rd Cross, Avalahalli Extension, Banashankari III Stage, Bangalore - 560085, Karnataka, India (hereinafter referred to as "Local Jyf", "Company", "we", "our" or "us").

These Terms constitute a legally binding agreement between Local Jyf and every person who accesses, browses, registers, advertises, posts employment opportunities, applies for jobs, purchases any service or otherwise uses the Platform ("User", "Employer", "Recruiter", "Job Seeker", "Candidate", "Visitor" or "You").

By accessing or using the Platform in any manner whatsoever, You acknowledge that You have carefully read, understood and agreed to be legally bound by these Terms, our Privacy Policy and all other policies published on the Platform from time to time. If You do not agree with any provision contained herein, You must immediately discontinue access to or use of the Platform.

These Terms are enforceable under the provisions of the Indian Contract Act, 1872, the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 and other applicable laws in force in India.

1. OBJECT OF THE PLATFORM

Local Jyf is a technology-enabled employment facilitating platform specifically designed to facilitate localized recruitment by enabling employers to advertise employment opportunities and allowing candidates to discover suitable jobs within their preferred geographical areas.

The Platform has been developed primarily to bridge the gap between employers and blue-collar, grey-collar and other workforce categories by improving last-mile employment discovery through location-focused recruitment.

The Platform enables employers to publish recruitment advertisements based upon selected geographical areas, business categories, job classifications and subscription plans while enabling candidates to search, review and respond to such advertisements according to their own preferences.

Local Jyf merely provides the technological infrastructure necessary for dissemination of employment advertisements and communication between employers and prospective candidates.

The Company neither recruits employees nor supplies manpower. It does not undertake placement activities, staffing services, labour contracting, outsourcing, consultancy or employment agency functions unless specifically agreed under a separate written agreement.

2. NATURE OF SERVICES

The services provided by Local Jyf include, but are not limited to:

  • Employer registration and verification.
  • Candidate registration.
  • Publication of recruitment advertisements.
  • Localized job discovery.
  • Advertisement management dashboard.
  • Resume collection and forwarding.
  • Candidate response analytics.
  • Advertisement history.
  • Premium advertisement options.
  • Subscription-based recruitment packages.
  • Communication facilities between employers and applicants.
  • Any additional services introduced from time to time.

The Company reserves the absolute right to modify, discontinue, suspend, enhance or introduce any service, feature or functionality without prior notice.

Nothing contained on the Platform shall create any obligation upon the Company to continue any particular feature or service.

3. NATURE OF THE PLATFORM

Local Jyf is purely an online technology intermediary.

The Company merely provides a digital marketplace where employers and job seekers may independently connect with each other.

  • The Company does not employ candidates.
  • The Company does not appoint employers.
  • The Company does not act as an employment exchange.
  • The Company is not a manpower consultant.
  • The Company is not a recruitment agency.
  • The Company is not a labour contractor.
  • The Company is not an outsourcing agency.
  • The Company is not an HR consultant.
  • The Company does not participate in interviews.
  • The Company does not negotiate salaries.
  • The Company does not conduct background verification unless specifically agreed under a separate written contract.
  • The Company does not guarantee employment.
  • The Company does not guarantee recruitment.
  • The Company does not guarantee the quality, suitability, competence, integrity, experience or credentials of any candidate or employer.

The Platform merely facilitates communication between independent parties.

Every employment relationship, if any, shall arise solely between the employer and the selected candidate.

Local Jyf shall never become a party to such employment relationship.

4. ELIGIBILITY

The Platform may be used only by persons who are legally competent to enter into contracts under the provisions of the Indian Contract Act, 1872.

By registering or using the Platform, every User represents and warrants that:

  • (a) he or she is at least eighteen (18) years of age;
  • (b) possesses full legal capacity to enter into binding agreements;
  • (c) all information furnished to the Company is true, complete and accurate;
  • (d) such information shall be updated whenever any material change occurs;
  • (e) the use of the Platform does not violate any law applicable to the User.

Where registration is made on behalf of a company, partnership firm, proprietorship, trust, educational institution or any other legal entity, the person creating the account warrants that he or she possesses the necessary authority to bind such organisation.

The Company reserves the right to seek documentary proof regarding identity, age, authority, business registration or any other information at any stage. Failure to furnish satisfactory documents may result in suspension or termination of the account.

5. ACCEPTANCE OF TERMS

By accessing the Platform, registering an account, posting advertisements, purchasing subscription packages, submitting resumes, applying for jobs or otherwise using any services offered by Local Jyf, the User expressly agrees:

  • to comply with these Terms;
  • to comply with the Privacy Policy;
  • to comply with all applicable laws;
  • to provide truthful information;
  • not to misuse the Platform;
  • not to undertake fraudulent activities;
  • not to interfere with the operation of the Platform.

Electronic acceptance of these Terms shall constitute a valid and enforceable agreement under the Information Technology Act, 2000.

No handwritten signature shall be necessary.

6. AMENDMENT OF TERMS

The Company reserves the unrestricted right to modify, amend, substitute, replace or update these Terms at any time without obtaining prior consent from Users.

Updated Terms shall become effective immediately upon publication on the Platform unless otherwise specified. Continued use of the Platform after such publication shall constitute unconditional acceptance of the revised Terms.

Users are advised to periodically review the Terms to remain informed of any changes.

7. DEFINITIONS

Unless the context otherwise requires, the following expressions shall have the meanings assigned to them:

  • Advertisement means every employment advertisement, recruitment notice, hiring campaign, vacancy announcement or promotional recruitment content uploaded on the Platform.
  • Candidate means any person searching for employment or responding to any advertisement published through the Platform.
  • Employer means any company, partnership, LLP, proprietorship, institution, NGO, trust, government body or individual using the Platform for recruitment.
  • Job Advertisement includes permanent, temporary, contractual, internship, apprenticeship, freelance, part-time or project-based employment opportunities.
  • Platform means the Local Jyf website, mobile application, APIs, software, databases, dashboards and all associated digital infrastructure.
  • Subscription means any paid advertisement package, premium plan, bulk package or promotional recruitment service offered or registration fees, if any, by Local Jyf.
  • User includes every visitor, employer, recruiter, candidate, advertiser or any other person using the Platform.

8. USER ACCOUNT REGISTRATION

Certain services may require registration. Users agree to provide complete and accurate information while creating their accounts. Users shall maintain the confidentiality of usernames, passwords and authentication credentials.

Every activity carried out through a registered account shall be deemed to have been authorised by the registered User. The Company shall not be liable for any misuse resulting from disclosure of login credentials.

The Company may suspend, deactivate or permanently terminate any account where:

  • false information has been furnished;
  • duplicate accounts have been created;
  • fraudulent activities are detected;
  • misuse of the Platform is noticed;
  • legal violations are reported;
  • the User breaches these Terms.

The Company may also refuse registration without assigning any reason.

9. ACCOUNT VERIFICATION

Local Jyf may require employers to submit documents such as GST Registration, Certificate of Incorporation, Trade Licence, MSME Registration, PAN, Aadhaar, business address proof, identity proof or any other document considered necessary for verification. Submission of documents shall not amount to certification, endorsement or guarantee by Local Jyf regarding the employer.

Similarly, candidates may be required to provide identity proof, educational documents, resumes or experience details.

Verification undertaken by the Company is limited only to the extent considered appropriate by the Company. Such verification shall never amount to a guarantee regarding authenticity, solvency, competence, financial standing, integrity or credibility of any User.

Users shall independently satisfy themselves regarding every transaction entered into through the Platform.

10. RIGHT TO REFUSE REGISTRATION

Local Jyf reserves the absolute and unfettered discretion to reject any registration application without assigning any reason whatsoever.

Without limiting the generality of the above, registration may be refused where:

  • the proposed User has previously violated these Terms;
  • false information has been submitted;
  • fraud is suspected;
  • the proposed business appears unlawful;
  • the proposed advertisement is misleading;
  • the proposed User is blacklisted by any regulatory authority;
  • there is any legal or reputational risk to the Company.

The Company's decision shall be final and binding and shall not be subject to challenge.

11. EMPLOYER REGISTRATION AND RESPONSIBILITIES

An Employer intending to advertise vacancies on the Platform shall register by providing complete, true and accurate information as may be prescribed by Local Jyf from time to time. The Company may require submission of business registration documents, GST registration, PAN, identity proof, address proof, trade licence, MSME certificate, or such other documents as may be considered necessary for verification.

Registration on the Platform shall not create any contractual obligation on the part of Local Jyf to publish every advertisement submitted by the Employer. The Company reserves the absolute right to verify the credentials of every Employer and may approve, reject, suspend or terminate any registration at its sole discretion.

Every Employer represents and warrants that all information uploaded on the Platform is genuine, lawful and complete and that the Employer possesses the legal authority to recruit personnel for the advertised position.

The Employer shall ensure that all advertisements accurately describe the job profile, designation, qualifications, experience, salary (where disclosed), place of work and other relevant employment conditions. Misleading, deceptive or false advertisements are strictly prohibited.

The Employer shall solely remain responsible for all recruitment decisions, interviews, negotiations, appointment letters, employment contracts, remuneration, statutory compliances, workplace safety, labour law obligations and all matters arising after selection of a candidate.

Local Jyf shall neither supervise nor participate in the employment relationship between the Employer and the Candidate.

12. JOB SEEKER REGISTRATION AND RESPONSIBILITIES

Candidates may register on the Platform for the purpose of searching and applying for employment opportunities.

Every Candidate warrants that the information furnished during registration, including educational qualifications, work experience, technical skills, certifications, contact details and uploaded resume, is accurate and not misleading.

The Candidate shall not upload forged certificates, manipulated resumes, false experience certificates, fabricated employment records or any misleading information.

The Candidate acknowledges that Employers shall rely upon the information submitted through the Platform while evaluating applications.

The Candidate shall be solely liable for any civil, criminal or contractual consequences arising out of false representations made through the Platform.

Local Jyf reserves the right to suspend or permanently remove any Candidate account if fraudulent information, impersonation or misuse of the Platform is detected.

13. NATURE OF JOB ADVERTISEMENTS

The Platform serves only as a medium for publication of employment advertisements submitted by Employers.

Publication of an advertisement does not amount to verification, certification, recommendation or endorsement of the Employer or the employment opportunity by Local Jyf.

Every advertisement published on the Platform represents solely the views and information supplied by the respective Employer.

The Company does not independently verify every factual statement contained in an advertisement and therefore disclaims all responsibility for inaccuracies, omissions or misrepresentations.

Candidates are advised to independently verify every employment opportunity before accepting any offer of employment.

14. LOCALIZED JOB DISCOVERY

One of the distinguishing features of Local Jyf is its geographically focused recruitment model.

Employers may publish advertisements by selecting specific cities, localities, zones, neighbourhoods or other geographical areas supported by the Platform.

Candidates may search employment opportunities based upon categories, sub-categories, preferred work locations and nearby geographical regions.

The Company may modify geographical classifications, introduce additional locations, merge regions or discontinue any geographical segment without prior notice.

The Company does not guarantee that every advertisement will reach every potential candidate located within the selected geographical area.

Advertisement visibility depends upon numerous technical, commercial and operational parameters including subscription package, search preferences, platform usage and system algorithms.

15. JOB POSTING POLICY

Employers shall ensure that every job advertisement complies with all applicable laws.

Advertisements shall not contain any information that is: false; misleading; fraudulent; defamatory; obscene; discriminatory; illegal; offensive; deceptive;or otherwise contrary to public policy.

Advertisements requiring payment from candidates for recruitment, interviews, training, security deposits or employment opportunities are strictly prohibited unless expressly permitted under applicable law.

Advertisements involving unlawful employment, trafficking, forced labour, bonded labour, prohibited occupations or illegal activities shall be immediately removed without notice.

The Company reserves the unrestricted right to reject, edit, suspend or remove any advertisement at any time if it considers such advertisement to be inappropriate or inconsistent with these Terms.

16. ADVERTISEMENT REVIEW AND APPROVAL

Every advertisement submitted through the Platform may be reviewed by Local Jyf before publication.

The Company may request modification of the advertisement, seek clarification from the Employer or require additional supporting documents.

Publication timelines are only indicative and shall not constitute a contractual commitment. The Company reserves the right to refuse publication of any advertisement without assigning reasons.

No claim shall lie against the Company merely because an advertisement has not been published or has been removed.

17. ADVERTISEMENT DURATION

Unless otherwise specified under the selected subscription package, every advertisement shall remain active only for the period purchased by the Employer. Upon expiry of the advertisement period, the advertisement may automatically become inactive or be removed from public view.

The Company may archive expired advertisements for administrative purposes. The Employer may purchase additional advertisement periods or renewal packages subject to the pricing applicable at the relevant time.

The Company shall have no obligation to restore expired advertisements.

18. SUBSCRIPTION PLANS AND BULK EMPLOYERS

The Company may offer various subscription plans including single advertisements, premium advertisements, highlighted advertisements, package subscriptions and customised recruitment solutions.

Employers classified by the Company as Bulk Employers may be offered customised commercial arrangements including credit facilities, negotiated pricing, advertisement packages or other promotional benefits.

Any credit facility extended by the Company shall remain entirely discretionary. The Company may revise, withdraw or suspend any credit facility without assigning reasons. Bulk Employers may additionally be required to execute separate written agreements governing commercial terms.

In the event of any inconsistency between these Terms and such written agreement, the written agreement shall prevail to the extent of such inconsistency.

19. PAYMENT TERMS

All payments shall be made in Indian Rupees through payment methods approved by the Company.The Company reserves the right to revise pricing at any time without prior notice.

The Employer agrees to pay all applicable charges, taxes, platform fees, subscription charges, convenience fees and applicable GST. Pricing applicable on the date of purchase shall govern the relevant transaction.

The Company may suspend publication of advertisements where payment remains unsuccessful, disputed or reversed. The Company shall not be responsible for delays arising due to banking systems, payment gateways, UPI providers or other third-party payment intermediaries.

20. NO CANCELLATION AND REFUND POLICY

Unless expressly provided under a separate written agreement, all advertisement purchases shall be final.

Once an advertisement has been published, no cancellation, refund, replacement or adjustment shall ordinarily be permitted. Requests for cancellation prior to publication may be considered solely at the discretion of the Company.

Where any refund is approved, the Company may deduct administrative charges, payment gateway charges, taxes and other applicable deductions. No refund shall be payable merely because the Employer receives fewer applications than anticipated or is unable to recruit suitable candidates.

The Company expressly disclaims any guarantee regarding the number or quality of responses received.

21. RESPONSE ANALYTICS

The Platform may provide Employers with response analytics, applicant statistics, advertisement history, application counts and related recruitment information on the terms and conditions agreed upon.

Such analytics are generated automatically through the Platform and are provided solely for informational purposes. The Company does not warrant their completeness, accuracy or uninterrupted availability.

Employers shall independently evaluate all applicants before making recruitment decisions.

22. COMMUNICATION BETWEEN EMPLOYERS AND CANDIDATES

The Platform may facilitate communication between Employers and Candidates through telephone numbers, email addresses, application forms or other communication mechanisms.

The Company merely facilitates such communication. The Company does not monitor every communication exchanged between Users. Users shall communicate professionally and lawfully.

Harassment, abusive language, threats, spam, fraudulent solicitations, phishing, misleading communications or unlawful conduct shall constitute material breaches of these Terms.

The Company reserves the right to suspend offending accounts immediately.

23. PLATFORM FEES

The Company reserves the right to levy registration fees, advertisement charges, premium listing charges, subscription fees, transaction charges, convenience fees, service charges or any other charges for use of the Platform.

All applicable charges shall be displayed before completion of payment. Taxes shall be charged in accordance with applicable law.

Failure to pay any outstanding amount may result in suspension of services.

24. NO GUARANTEE OF EMPLOYMENT OR RECRUITMENT

The Company does not guarantee that:

  • every advertisement will receive responses;
  • every response will be genuine;
  • every Employer will recruit;
  • every Candidate will secure employment;
  • every interview will culminate in appointment;
  • every recruitment process will be completed successfully.

The Employer acknowledges that recruitment depends upon numerous factors beyond the Company's control.

Similarly, every Candidate acknowledges that selection depends entirely upon the Employer's independent assessment.

The Company shall never be liable merely because employment is not secured or recruitment remains unsuccessful.

25. NO EMPLOYMENT RELATIONSHIP

Nothing contained on the Platform shall be construed as creating any employer-employee relationship between Local Jyf and any Candidate.

Similarly, no agency, partnership, joint venture, consultancy or fiduciary relationship shall arise between Local Jyf and any Employer merely because the Employer uses the Platform.

The Company functions solely as a technology service provider facilitating publication and discovery of employment opportunities.

All employment contracts, appointments and service relationships shall exist exclusively between Employers and Candidates.

The Company shall have no liability in relation to salaries, incentives, service conditions, termination, resignation, retrenchment, gratuity, provident fund, ESI, bonus, leave, disciplinary proceedings or any labour or employment dispute whatsoever.

26. PRIVACY AND PERSONAL DATA

Local Jyf recognises the importance of protecting the privacy of every User. During the course of registration and use of the Platform, the Company may collect personal information including, without limitation, the User's name, address, mobile number, email address, educational qualifications, employment history, business details, payment information, identity documents, location preferences, IP address, device information and other information voluntarily provided by the User.

Such information shall be collected, processed, stored, used and disclosed only for legitimate business purposes including user authentication, employer verification, candidate registration, publication of advertisements, communication between Employers and Candidates, payment processing, customer support, fraud prevention, legal compliance, analytics and improvement of the Platform.

The Company shall process personal data in accordance with the Digital Personal Data Protection Act, 2023 and other applicable laws. Users consent to such processing by registering or using the Platform.

The Company shall implement commercially reasonable administrative, technical and organisational safeguards to protect personal information. However, no internet-based platform can guarantee absolute security and the Company shall not be liable for unauthorised access, cyber-attacks or security breaches beyond its reasonable control.

The Company's Privacy Policy shall form an integral part of these Terms.

27. COOKIES, ANALYTICS AND PLATFORM TECHNOLOGY

The Platform may utilise cookies, web beacons, browser storage, analytics tools and similar technologies to improve functionality, enhance user experience, understand usage patterns, prevent fraud and personalise services.

Users consent to the use of such technologies by continuing to use the Platform.

Users may disable cookies through browser settings; however, certain features of the Platform may become unavailable or function improperly.

28. USER GENERATED CONTENT

Users may upload resumes, company profiles, logos, advertisements, photographs, business descriptions, comments, reviews and other content.

The User represents that all such content:

  • belongs to the User or is lawfully licensed;
  • does not infringe intellectual property rights;
  • does not violate privacy rights;
  • does not contain defamatory, obscene or unlawful material;
  • does not contain malicious software or harmful code.

The User shall remain solely responsible for all content uploaded to the Platform.

The Company shall have the right, but not the obligation, to monitor, edit, reject or remove any content without prior notice.

29. LICENCE GRANTED TO LOCAL JYF

By uploading any advertisement, logo, company information, resume, photograph or other content, the User grants Local Jyf a worldwide, non-exclusive, royalty-free, transferable licence to host, store, reproduce, display, distribute, index, modify for formatting purposes and publish such content for operating, promoting and improving the Platform.

This licence shall continue for as long as such content remains on the Platform and for a reasonable archival period thereafter where required for legal or operational purposes.

30. INTELLECTUAL PROPERTY RIGHTS

The Platform, including its software, source code, databases, algorithms, layout, design, graphics, trademarks, logos, trade names, domain names, compilations, user interface, content and all related intellectual property rights are and shall remain the exclusive property of ValVicino Technologies Private Limited or its licensors.

Nothing contained in these Terms shall confer upon any User any ownership or proprietary rights over the Platform.

Users shall not copy, reproduce, reverse engineer, decompile, scrape, modify, distribute, create derivative works, sell, license or commercially exploit any portion of the Platform without the Company's prior written consent.

Unauthorised use of the Company's intellectual property may result in civil and criminal proceedings.

31. ACCEPTABLE USE POLICY

Users shall not:

  • use the Platform for unlawful purposes;
  • impersonate any person or organisation;
  • create multiple fraudulent accounts;
  • upload viruses, malware or malicious software;
  • attempt unauthorised access to the Platform;
  • interfere with the operation of the Platform;
  • harvest user information;
  • send spam or unsolicited communications;
  • post discriminatory, abusive or offensive material;
  • advertise unlawful employment opportunities;
  • seek payments from candidates for employment in violation of applicable law;
  • misuse the Platform in any manner prejudicial to the Company or other Users.

Violation of this clause may result in immediate suspension without prior notice.

32. FRAUD PREVENTION

The Company reserves the right to investigate suspicious activities, verify user identities, seek additional documentation and cooperate with law enforcement agencies whenever fraud, identity theft, cybercrime, forgery, phishing or other unlawful activities are suspected.

The Company may suspend or permanently terminate any account pending such investigation.

Users shall cooperate fully with any investigation conducted by the Company.

33. THIRD-PARTY SERVICES

The Platform may integrate payment gateways, communication providers, cloud hosting services, mapping services, SMS gateways, email providers, analytics platforms and other third-party technologies.

Such third-party services are governed by their own terms and privacy policies.

The Company shall not be responsible for any interruption, delay, failure, security incident or loss attributable to such third-party service providers.

34. DISCLAIMER OF WARRANTIES

The Platform and all services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, the Company disclaims all express and implied warranties including warranties relating to availability, merchantability, fitness for a particular purpose, uninterrupted operation, non-infringement, accuracy and reliability.

Without limiting the foregoing, Local Jyf does not warrant:

  • that the Platform will operate without interruption;
  • that every advertisement will receive responses;
  • that every candidate is genuine;
  • that every employer is financially sound;
  • that every resume is accurate;
  • that every employment opportunity is lawful;
  • that employment will be secured;
  • that recruitment will be successful;
  • that communications between Users will always be secure.

Users acknowledge that they use the Platform entirely at their own risk.

35. NO RESPONSIBILITY FOR EMPLOYMENT DISPUTES

The Company shall not be responsible for any dispute arising between Employers and Candidates including disputes relating to recruitment, salary, incentives, commissions, appointment letters, probation, confirmation, transfers, misconduct, disciplinary proceedings, termination, resignation, retrenchment, harassment, discrimination, workplace injuries, statutory benefits, taxation, provident fund, gratuity, leave, insurance, confidentiality obligations or restrictive covenants.

Every such dispute shall be resolved solely between the concerned Employer and Candidate.

36. INDEMNITY

Every User agrees to indemnify, defend and hold harmless ValVicino Technologies Private Limited, its promoters, directors, shareholders, officers, employees, consultants, affiliates, licensors and authorised representatives from and against any claims, actions, proceedings, liabilities, losses, damages, penalties, costs and expenses (including reasonable legal fees) arising directly or indirectly from:

  • breach of these Terms;
  • violation of applicable law;
  • infringement of intellectual property rights;
  • false information supplied by the User;
  • employment disputes;
  • misuse of the Platform;
  • fraudulent activities;
  • third-party claims arising out of content uploaded by the User;
  • or any negligent or wrongful act or omission of the User.

This obligation shall survive termination of these Terms.

37. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Local Jyf, ValVicino Technologies Private Limited, its directors, officers, employees and affiliates shall not be liable for any indirect, consequential, incidental, punitive, exemplary or special damages including loss of business, goodwill, profits, revenue, opportunity, reputation or data.

Without prejudice to the foregoing, the aggregate liability of the Company arising out of or relating to these Terms shall never exceed the actual subscription fee paid by the concerned User to the Company during the three months immediately preceding the event giving rise to the claim.

38. FORCE MAJEURE

The Company shall not be liable for any delay or failure in performance caused by events beyond its reasonable control including acts of God, flood, earthquake, pandemic, epidemic, war, terrorism, riots, governmental restrictions, internet failures, cyber-attacks, power outages, strikes, labour unrest, payment gateway failures, cloud infrastructure failures or other force majeure events.

39. SUSPENSION AND TERMINATION

The Company may suspend, restrict or permanently terminate any account without prior notice where:

  • these Terms are violated;
  • fraud is suspected;
  • false information has been furnished;
  • the Platform is misused;
  • payment obligations remain unpaid;
  • legal proceedings require such action;

Termination shall not affect accrued rights, payment obligations or indemnity provisions.

40. ELECTRONIC COMMUNICATIONS

Users consent to receive communications from the Company electronically including by email, SMS, WhatsApp, mobile notifications and other digital means.

Such communications shall satisfy any legal requirement that notices be in writing.

41. GRIEVANCE REDRESSAL

Any complaint regarding the Platform may be addressed to the Grievance Officer designated by the Company.

The name, designation, postal address, email address and contact particulars of the Grievance Officer shall be published on the Platform and may be revised from time to time.

The Company shall endeavour to acknowledge and resolve genuine grievances within a reasonable period in accordance with applicable law.

42. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.

43. DISPUTE RESOLUTION AND ARBITRATION

Any dispute, controversy or claim arising out of or relating to these Terms, the Platform or any services provided by the Company shall, as far as possible, be resolved amicably through mutual discussions.

Failing such resolution within thirty (30) days, the dispute shall be referred to arbitration under the provisions of the Arbitration and Conciliation Act, 1996, as amended.

The arbitration shall be conducted by a Sole Arbitrator appointed mutually by the parties. In the absence of consensus, the appointment shall be made in accordance with applicable law.

The seat and venue of arbitration shall be Bengaluru, Karnataka. The proceedings shall be conducted in the English language.

The arbitral award shall be final and binding.

Nothing contained herein shall prevent the Company from seeking interim or injunctive relief before a court of competent jurisdiction.

44. JURISDICTION

Subject to the arbitration provisions contained herein, the courts at Bengaluru, Karnataka alone shall have exclusive jurisdiction over all matters arising out of these Terms.

45. SEVERABILITY

If any provision of these Terms is held to be unlawful, invalid or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.

46. WAIVER

Failure by the Company to enforce any provision of these Terms shall not constitute a waiver of its rights.

No waiver shall be effective unless made in writing.

47. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Cookie Policy and any other policies published on the Platform, constitute the complete agreement between the Company and the User and supersede all prior understandings, representations and communications relating to the subject matter hereof.

49. EFFECTIVE ACCEPTANCE

By clicking "I Agree", "Register", "Submit", "Proceed", "Pay Now", "Apply", "Post Job", "Continue" or by otherwise accessing or using any part of the Platform, every User acknowledges that he, she or it has carefully read, understood and voluntarily accepted these Terms of Service and agrees to be legally bound by them.

These Terms shall constitute a valid electronic contract enforceable under the Information Technology Act, 2000 and other applicable laws of India.
